molestas por parte de las vecinos o inquilinos y el procedimiento a realizar,
nos parece interesante comentar la reciente sentencia de <st1:personname productid="la Audiencia" w:st="on">la Audiencia</st1:personname> de Valencia
que ha condenado a un hombre y una mujer a no residir en su propia vivienda
durante tres meses después de que <strong><span style="font-family: "Arial","sans-serif";">sus
vecinos de finca les denunciaran por las molestias y ruidos que causaban</span></strong>.<o:p></o:p></span></div>

<span style="font-family: "Arial","sans-serif"; font-size: 10pt;">La
comunidad de propietarios de la finca, ubicada en la localidad valenciana de
Xirivella, demandó a la pareja por las "molestias y ruidos, sobre todo
nocturnos", que provenían de su casa desde finales de 2006.<o:p></o:p></span></div>

<span style="font-family: "Arial","sans-serif"; font-size: 10pt;">La
relación entre demandantes y demandados derivó además en un juicio de faltas
por amenazas y agresión que acabó con sentencia absolutoria, y burofaxes y un
acto de conciliación requiriendo a la pareja el cese del ruido denunciado.<o:p></o:p></span></div>

molestias cesaron durante algún tiempo pero se reanudaron en 2009, como
continuaron denunciando los vecinos y consta en diferentes intervenciones

vecinos plasmaron sus quejas en actas, llevaron a cabo requerimientos
fehacientes, llamadas a la policía y una vez finalizado el procedimiento
judicial, han conseguido esta novedosa sentencia.<o:p></o:p></span></div>

<span style="font-family: "Arial","sans-serif"; font-size: 10pt;">Según
la jurisprudencia que recoge la sentencia, no está permitido al propietario u ocupante
de un piso desarrollar en éste actividades prohibidas que resulten dañosas para
la finca o contravengan las disposiciones generales sobre actividades molestas,
insalubres, nocivas, peligrosas o ilícitas.<o:p></o:p></span></div>

juez ha considerado probado que las "actividades molestas, nocivas e
ilícitas existen" en la vivienda de los denunciados desde el año 2006 y

</div><div class="MsoNormal" style="margin: 0pt; text-align: justify;"><span style="font-family: Arial; font-size: 11pt;">En la mayoría de las sociedades democráticas actuales hay grupos de individuos que cuestionan la legitimidad del sistema establecido y que, desean imponer, en muchos casos por la fuerza, un nuevo sistema que consideran más conveniente a sus intereses particulares. Desgraciadamente en muchos casos los caminos elegidos para reivindicar lo que estos individuos consideran “lo correcto” pasan por sembrar el pánico, amenazar, aterrorizar a las masas, atentar contra la vida de personas, etc. todo ello lo hacen en el convencimiento de que, el seguir sus deseos traerá un mayor bienestar a la sociedad, o al menos, a ellos mismos.</span></div><div class="MsoNormal" style="margin: 0pt; text-align: justify;"><br />
</div><div class="MsoNormal" style="margin: 0pt; text-align: justify;"><span style="font-family: Arial; font-size: 11pt;">Dado que las Comunidades de Propietarios son un sistema democrático, también nos encontramos tristemente y salvando las distancias, a individuos que, en lugar de trabajar por el bien de su comunidad, presentarse a las elecciones para ser elegidos democráticamente, informarse debidamente de las realidades de las Comunidades de las que forman parte, etc. se dedican con gran tenacidad a discutir y cuestionar cualquier decisión que se adopte, amenazar con acciones legales, criticar ferozmente y sin sentido a los Órganos de gobierno de la comunidad, enviar comunicados, escribir en foros calumnias, crear blogs para insultar, etc.</span></div><div class="MsoNormal" style="margin: 0pt; text-align: justify;"><br />
</div><div class="MsoNormal" style="margin: 0pt; text-align: justify;"><span style="font-family: Arial; font-size: 11pt;">Sinceramente entiendo que, con las debidas distancias, el mismo rechazo que nos deben generar los intolerantes en una sociedad democrática es el que nos deberían generar aquellos propietarios que, en muchas ocasiones en una búsqueda de inconfesables beneficios personales, ponen todo su empeño en desestabilizar los legítimos órganos de gobierno de una Comunidad con argumentaciones falsas, sin tener la más remota idea del funcionamiento o legalidad, buscando la creación de un estado de opinión de sospecha continua sobre las actuaciones de la misma que pueda favorecer a sus propósitos, sean estos la búsqueda de un beneficio personal, la lucha por un poder que creen que les debe pertenecer por nacimiento, o la necesidad de autoestima.</span></div><div class="MsoNormal" style="margin: 0pt; text-align: justify;"><br />
</div><div class="MsoNormal" style="margin: 0pt; text-align: justify;"><span style="font-family: Arial; font-size: 11pt;">Ello es, por supuesto distinto, a aquellos propietarios que, con críticas constructivas, pretenden realmente que se mejore día a día en sus Comunidades aportando ideas positivas, colaborando en las materias de las que son conocedores, dialogando con el objetivo del bien común.</span></div><div class="MsoNormal" style="margin: 0pt; text-align: justify;"><br />
</div><div class="MsoNormal" style="margin: 0pt; text-align: justify;"><span style="font-family: Arial; font-size: 11pt;">Como en cualquier sociedad democrática, la grandeza o miseria en el futuro de una Comunidad dependerá en buena medida, de la capacidad de sus componentes de analizar críticamente y aislar a aquellos individuos que buscan básicamente instaurar un régimen de terror cuestionando todo lo democráticamente establecido y erigirse como faros salvadores de unas Comunidades de Propietarios en contra de quienes, con su mejor intención, realmente dedican su tiempo y esfuerzo en mejorarla. </span></div><div class="MsoNormal" style="margin: 0pt; text-align: justify;"><br />
</div><div class="MsoNormal" style="margin: 0pt; text-align: justify;"><span style="font-family: Arial; font-size: 11pt;">He ahí el reto que afrontan frecuentemente los miembros de una Comunidad de Propietarios, sus órganos de gobierno legítimamente establecidos y como siempre, sus Administradores de Fincas.</span></div><div class="MsoNormal" style="margin: 0pt; text-align: justify;"><br />

Unfortunately, in many cases the paths chosen to demand what these individuals considered “correct” go from threatening, terrorizing masses and attempting against the life of people. All of such is done with the convincement that, following their desires will bring a mayor well being to society or a least for themselves.</span></div><div class="MsoNormal" style="margin: 0pt; text-align: justify;"><br />
</div><div class="MsoNormal" style="margin: 0pt; text-align: justify;"><span lang="EN-GB" style="font-family: Arial; font-size: 11pt; mso-ansi-language: EN-GB;">Since the communities of owners are <span style="mso-spacerun: yes;"> </span>democratic systems, we also find ourselves, sadly and bridging the gap, individuals that instead of working to better their community, presenting themselves to the elections to be elected democratically and informing <span style="mso-spacerun: yes;"> </span>themselves duly of the realities of the communities of which they are part of , they dedicate with extreme persistence to debate and question any decision adopted , threaten with legal actions, criticize furiously<span style="mso-spacerun: yes;"> </span>and with no sense<span style="mso-spacerun: yes;"> </span>the members that govern the community, send memos, write slanderous rumours in forums , create blogs to insult, etc. </span></div><div class="MsoNormal" style="margin: 0pt; text-align: justify;"><br />
</div><div class="MsoNormal" style="margin: 0pt; text-align: justify;"><span lang="EN-GB" style="font-family: Arial; font-size: 11pt; mso-ansi-language: EN-GB;">I do sincerely understand that, the same reject that is generated towards intolerant people in a democratic society would be that generated by those owners that, in many occasions in a search for an unmentionable personal benefit, put all their effort to destabilise the legitimate members that govern the community with false argumentations, with the slightest idea of how it works or legality, trying to create a climate of continuous suspicion with regards to the community’s performance so that it can beneficiate their purposes, being these the search of a personal benefit, the struggle for a power that they think belongs to them by birth, or the need for self-esteem. </span></div><div class="MsoNormal" style="margin: 0pt; text-align: justify;"><br />
</div><div class="MsoNormal" style="margin: 0pt; text-align: justify;"><span lang="EN-GB" style="font-family: Arial; font-size: 11pt; mso-ansi-language: EN-GB;">That is, of course different, to those owners who, with constructive criticism , really try to better day by day their communities contributing with positive ideas, collaborating in those areas where they have knowledge and discussing for a common goal.</span></div><div class="MsoNormal" style="margin: 0pt; text-align: justify;"><br />
</div><div class="MsoNormal" style="margin: 0pt; text-align: justify;"><span lang="EN-GB" style="font-family: Arial; font-size: 11pt; mso-ansi-language: EN-GB;">Like in any other democratic society, the greatness or misery in the future of a community will depend in great measure, of the capability of its components to analyse critically and isolate those individuals that basically are only looking for a regime of terror questioning everything democratically established and trying to set up themselves as false saviours of community of owners against those that, with their best intentions, really dedicate their time and effort to improve it. </span></div><div class="MsoNormal" style="margin: 0pt; text-align: justify;"><br />
